Public law tends to examine relationships between individuals and the government, in the matters of wider public interest. Public bodies and organisations carrying out a public function must act in a lawful manner. All decisions must be rationally and in a fair and reasonable manner.

What Is Judicial Review?

 

A claim for Judicial Review is the legal process of having the Court make a decision as to the lawfulness of a public body policy, act or omission. Judicial Review is the main tool that enables individuals to hold the government and public bodies to account. To be effective, public law remedies like judicial review have to be used without delay (in most cases the Court will need to be approached within three months, but in some cases much sooner).  If you suspect you may have been the subject of a public-body decision that is flawed. Such as being irrational, unlawful and procedurally unfair you may be able to challenge the decision of the body who made the decision with a Judicial Review claim.

RTW can assist you with these matters we have a strong success rate in challenging decisions particular those made by the Prison Service and or the Parole Board. We also specialise in challenging those decisions whereby there is a civil liberties/ human rights element.
